Dissolving TROs & Injunctions
A temporary restraining order can be entered ex parte — without notice, without a hearing, and sometimes against people who are not even parties to the lawsuit. A bank receives the order and freezes the account the same day. The people whose money it is find out when a card is declined.
The firm moves to modify or dissolve these orders quickly. That means reviewing the order and the underlying filings, getting the bank’s legal-order department on the record about what was frozen and why, and filing a motion — on the expedited schedule the rules allow — showing that the restrained funds have nothing to do with the plaintiff’s claims.
Under most states’ rules, a motion to modify or dissolve a TRO can be heard on a few days’ notice. The firm prepares the motion and supporting declarations, requests the expedited hearing, and argues it — remotely where the court permits — so that personal funds are released without waiting for the underlying lawsuit to run its course.
Ivan is admitted in California. For state-court matters elsewhere, the firm appears pro hac vice in association with local counsel licensed in that jurisdiction, so the motion can be filed and argued wherever the order was entered.
If a bank has frozen your funds under a court order, contact the firm immediately. These orders run on short clocks, and the time to act is measured in days.
Common questions
Dissolving TROs & Injunctions
My bank froze my account because of a court order from another state. Can you help?
Often, yes. Banks freeze accounts when they receive a restraining order or injunction, even when the account holder was never named in the lawsuit or notified of it. The remedy is a motion in the court that issued the order, asking it to modify or dissolve the freeze as to your funds. The firm prepares and files that motion, appearing pro hac vice with local counsel where the order was issued outside California. These orders and their hearing deadlines move quickly, so contact the firm as soon as the freeze happens.
Do you appear in court in person?
Court appearances are made remotely wherever the court allows. When a hearing must be attended in person, travel is billed at $300 per hour from departure until return, unless included in a written flat quote.
